1.Who this is between, and how you accept it
This Affiliate Programme Agreement (the “Agreement”) is between you (the “Affiliate”, “you”) and PrintPort3D (“we”, “us”, “our”). It governs your participation in our affiliate programme (the “Programme”) and nothing else.
You accept it by ticking the acceptance box on the application form at /partners. We record which version you accepted and when. Acceptance does not admit you to the Programme: applications are reviewed by a person and we may decline any application, for any reason or none, without explanation.
Where you also use our services as a seller or a buyer, the Terms of Service govern that use. Where this Agreement and the Terms conflict on a matter specific to the Programme, this Agreement governs.
2.Definitions
- Affiliate Link and Code
- The unique URL we issue you (of the form printport3d.com/r/your-code) and the code inside it, which a person may also type at signup.
- Referred Seller
- A person or business that creates a PrintPort3D seller account and is attributed to you under Section 4. Attribution is recorded once and is not transferable.
- Qualifying Charge
- The amount a Referred Seller actually pays us to manufacture, pack and ship one of their orders, as captured on their payment method. It is not their retail sale price, and it is not a share of our profit.
- Commission
- 10% of a Qualifying Charge, subject to the earning period and the exclusions in Section 5.
- Attribution Window
- 90 days from a click on your Affiliate Link, within which a signup is attributed to you. A Code typed at signup attributes regardless of the window.
- Programme Balance
- Commission that has accrued to you and has not yet been paid out.
3.What you may use, and what you may not
For as long as this Agreement is in force we grant you a personal, non-exclusive, non-transferable, revocable licence to use our name, wordmark and the marketing material we supply, solely to promote PrintPort3D and solely in the form supplied. You may describe the service accurately in your own words.
You may not:
- alter, redraw, animate or recolour our wordmark, or use it as your own avatar, channel art or product branding;
- register or use a domain name, social handle, app name or business name that contains our name or a confusingly similar variant;
- state or imply that you are PrintPort3D, are employed by us, speak for us, or that we endorse you, your other products, or anything you say beyond your own recommendation;
- make claims about our service that we have not published — earnings, turnaround times, capacity, materials, certifications or prices — including claims about what a typical seller earns.
4.How a referral is attributed to you
When somebody follows your Affiliate Link we record it in that browser for 90 days. If they create a seller account within that period, or enter your Code at signup, that account is attributed to you.
Attribution is recorded once per seller and does not change. If an account is already attributed to another affiliate, a later click on your link does not move it, and no commission accrues to you on that seller. We do not reassign attribution on request, including where two affiliates both claim the same referral.
Attribution depends on things outside our control — a person clearing cookies, using a different device without typing the Code, or a browser that blocks the recording. We do not guarantee that any particular referral will be attributed, and we do not reconstruct attribution after the fact from other evidence.
A person who arrives through your link also receives a credit of up to $25 towards their first order. That credit is between us and them; it does not reduce your Commission, and it is not payable to you.
5.What you earn, and on what
5.1The rate and the earning period
You earn 10% of each Qualifying Charge paid by a Referred Seller, on charges captured in the 12 months (365 days) following the date that seller is attributed to you (the “Earning Period”). After it ends, no further commission accrues on that seller's orders, however much they go on to spend and however long they stay with us.
The Earning Period is counted per seller, from that seller's own attribution date — not per affiliate, and not from the date you joined the Programme. There is no limit on how many orders a Referred Seller may place inside it.
Commission accrues when the seller's charge is captured — not when they place an order, and not at a monthly close. A charge captured after the Earning Period has ended does not earn, even where the order was placed before it ended.
5.2What does not earn commission
- Anything other than a Qualifying Charge: a seller's own retail sales, their customers' payments to them, subscription or platform fees, taxes and duties.
- Orders placed before the seller was attributed to you.
- Orders on an account attributed to another affiliate, or to no affiliate.
- Orders that are refunded, charged back or otherwise reversed — see 5.3.
- Any charge on an account that we determine was created or used in breach of Section 7.
5.3Refunds and reversals
If a Qualifying Charge is refunded or reversed in whole or in part, the Commission on it is reversed. If it has already been paid to you, we may deduct the amount from your Programme Balance or, where the balance is insufficient, from future Commission. We do not invoice you for a negative balance.
5.4Changes to the rate
We may change the rate, the Earning Period or the Attribution Window on 30 days' notice to the email address on your Programme account. Changes apply prospectively only: Commission already accrued is paid at the rate in force when it accrued, and a seller already attributed to you keeps the Earning Period they were attributed under.
6.How and when you are paid
Payouts are made by transfer to a Stripe account in your own name. You must complete Stripe's onboarding, which collects your bank details and tax information directly; we never receive or store them. Until that is complete, Commission accrues but cannot be sent.
- Where. We can pay bank accounts in United States. This is about where your account is, not where your audience is.
- Minimum. A payout must be at least $1. Smaller balances continue to accrue.
- When. There is no fixed payout date. A person reviews accrued balances and releases them; Stripe's own schedule then applies to the transfer.
- Currency. Commission accrues and is paid in US dollars. Any conversion, and any fee your bank charges for it, is yours.
- Tax. You are responsible for your own taxes. Where required, Stripe issues the applicable tax form (in the United States, a 1099).
We may withhold a payout while we investigate a suspected breach of Section 7, or where a chargeback or refund on a Referred Seller's order is pending. We will tell you that a payout is being withheld.
7.What you must not do
Doing any of these forfeits the commission it produced
- Self-referral. Referring yourself, a household member, an account you own or control, or a business you are part of.
- Signing people up for them. Creating accounts on somebody else's behalf, or completing signup for them using your link.
- Paid search on our name. Bidding on our brand name or close variants, or running ads that appear to be ours.
- Coupon, deal and cashback listings. Posting your link on coupon, voucher or cashback sites, or as a "discount code" for a discount we have not published.
- Unsolicited messaging. Bulk or unsolicited email, DMs, comment spam, or any promotion that breaches the CAN-SPAM Act or an equivalent law.
- Forced or hidden clicks. Cookie stuffing, auto-redirects, iframes, pop-unders, extensions, or anything that records a click the person did not make.
- Misrepresentation. False claims about the service, invented earnings figures, fake reviews, or impersonating us or a seller.
- Illegal or hateful placement. Promoting through material that is unlawful, infringing, sexually explicit, or that attacks people on the basis of who they are.
Where we determine that a referral resulted from any of the above, the Commission on it does not accrue and any amount already paid is recoverable under 5.3. Repeated or deliberate breach ends your participation under Section 9, and may forfeit an unpaid Programme Balance in full.
8.You must disclose the relationship
When you promote us you must make clear that you earn a commission. In the United States this is required by the FTC's Endorsement Guides, 16 C.F.R. Part 255; most other jurisdictions and most platforms require the equivalent.
The disclosure must be plain, in the same language as the content, and where a person will actually see it — not only in a description that has to be expanded, a hashtag among many, or a page of small print. Wording such as “I earn a commission if you sign up through my link” is sufficient. Where a platform provides its own paid-partnership tool, use it as well, not instead.
9.Ending it
Either of us may end this Agreement at any time, for any reason, by notice to the other — for you, an email to support@printport3d.com; for us, an email to the address on your Programme account. We may also suspend your participation immediately while we investigate a suspected breach of Section 7.
On termination:
- your licence under Section 3 ends immediately, and you must stop using our name and marks and remove your Affiliate Links within a reasonable time;
- Commission that accrued on legitimate referrals before termination remains payable, subject to the minimum in Section 6 and to any reversal under 5.3;
- no further Commission accrues on sellers already attributed to you;
- where we terminate for a deliberate breach of Section 7, your unpaid Programme Balance may be forfeited in full.
10.Your dashboard and what it shows
We give you a private dashboard link. It is a credential: anyone who has it can read your Programme figures, so treat it as you would a password. Tell us at support@printport3d.com if it is exposed.
The dashboard shows aggregates about your own referrals only — counts, rates and totals. It shows nothing that identifies a Referred Seller, and we will not provide their identity, contact details or order history to you. Their relationship with us is theirs.
Figures shown are our records and may be adjusted for reversals, corrections or investigations. Where the dashboard and our accounting records disagree, our accounting records govern.
11.We are not partners, and you are not staff
You are an independent contractor. Nothing here creates an employment relationship, a partnership, a joint venture, a franchise or an agency, and neither of us may bind the other or incur liabilities on the other's behalf. You decide when, where and how you promote; we do not direct your content.
You are responsible for your own equipment, costs, insurance and taxes, and for complying with the rules of any platform you post on.
12.What we do not promise
We do not promise that you will earn anything. We make no representation about how many people will click, sign up, or become sellers, or about what any affiliate earns or has earned. Any figure produced by a calculator on our site multiplies numbers you entered and is not a projection.
We may change, suspend or discontinue the Programme, in whole or in part, on 30 days' notice — except where we must act sooner to comply with law or to stop abuse. Commission already accrued is unaffected.
13.Liability, law and disputes
The following sections of the Terms of Service are incorporated into this Agreement and apply to it as though set out here in full, with references to the Services read as references to the Programme: Disclaimers, Limitation of liability, Indemnification, Governing law and forum, and Dispute resolution, arbitration and class action waiver.
This includes an arbitration agreement and a class action waiver
Unless you opt out as described in the Terms, most disputes arising out of this Agreement go to individual arbitration rather than court, and you give up the right to take part in a class action. Small claims and claims for public injunctive relief are not affected, and if you are a consumer in the EU or UK it does not apply to you. How to opt out.
You indemnify us for claims arising out of how you promoted us — including any claim that your content was misleading, infringing, or failed to disclose this relationship.
14.General, and how to reach us
This Agreement is the entire agreement between us about the Programme and supersedes any earlier understanding about it. If a provision is unenforceable, the rest stands. Our not enforcing something is not a waiver of it. You may not assign this Agreement; we may assign it to a successor or a buyer of the business on notice to you.
We may amend this Agreement on 30 days' notice for material changes, or immediately for changes that are required by law or that are in your favour. Continuing in the Programme after a change takes effect is acceptance of it; if you do not accept, end the Agreement under Section 9.
