Introduction and Acceptance of Terms
Welcome to PrintPort3D ("Company," "we," "us," or "our"). These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you and PrintPort3D, governing your access to and use of the PrintPort3D website located at printport3d.com, our mobile applications, and all related services, features, content, and functionality (collectively, the "Services" or "Platform").
PrintPort3D operates as a technology platform that connects individuals and businesses seeking 3D printing services ("Buyers") with sellers who offer products created through 3D printing technology ("Sellers"). We also provide direct 3D printing fulfillment services, file processing, and related manufacturing services.
PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES. BY ACCESSING OR USING THE SERVICES, CREATING AN ACCOUNT, OR CLICKING "I AGREE," YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.
THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE REVIEW SECTIONS 19 AND 20 CAREFULLY.
PrintPort3D is operated from the State of California, United States. These Terms shall be governed by California law as set forth herein.
1. Definitions
The following definitions apply throughout these Terms:
- "User," "you," or "your" means any individual or entity that accesses or uses the Services, including Buyers and Sellers.
- "Account" means a registered user account on the Platform.
- "Content" means any and all 3D model files (including but not limited to STL, OBJ, 3MF, STEP, and other file formats), designs, images, photographs, text, descriptions, pricing information, or other materials uploaded, submitted, posted, or transmitted through the Services.
- "User Content" means Content that is uploaded, submitted, or created by Users.
- "Products" means physical items manufactured through 3D printing or related additive manufacturing processes based on Content.
- "Seller" means a User who lists Products for sale, uploads designs for commercial distribution, or otherwise offers goods or services through the Platform.
- "Buyer" means a User who purchases Products or services through the Platform.
- "Intellectual Property Rights" means all patents, copyrights, trademarks, trade secrets, trade dress, rights of publicity, moral rights, and any other intellectual property or proprietary rights recognized under any applicable law.
- "Third-Party Content" means Content owned by parties other than the User uploading such Content.
- "Order" means a request to purchase Products through the Platform.
- "Additive Manufacturing" means any manufacturing process that creates three-dimensional objects by building up material layer by layer, including but not limited to Fused Deposition Modeling (FDM), Stereolithography (SLA), Selective Laser Sintering (SLS), Multi Jet Fusion (MJF), and other 3D printing technologies.
- "Build Parameters" means the technical specifications and settings used in the Additive Manufacturing process, including but not limited to layer height, infill percentage, print speed, temperature settings, support structures, and orientation.
- "Manufacturing Tolerance" means the acceptable range of dimensional variation in a manufactured Product, typically expressed as a plus or minus value from the nominal dimension.
- "Post-Processing" means any finishing operations performed on a Product after the initial Additive Manufacturing process, including but not limited to support removal, sanding, polishing, painting, dyeing, vapor smoothing, or assembly.
- "Material" means the raw substance used in Additive Manufacturing, including but not limited to PLA, ABS, PETG, TPU, Nylon, Resin, and other thermoplastics, photopolymers, or composite materials.
- "File" or "Model File" means digital 3D model data in any supported format that can be processed for Additive Manufacturing.
- "Slicing" means the process of converting a 3D model file into machine-readable instructions (G-code or equivalent) for Additive Manufacturing equipment.
- "Manifest Errors" means defects in a Product that are clearly visible and apparent upon reasonable inspection, including but not limited to failed prints, missing features, incorrect colors, or significant dimensional inaccuracies.
- "Latent Defects" means defects in a Product that are not discoverable through reasonable inspection at the time of delivery.
- "Store" or "Seller Store" means a Seller's dedicated page or section on the Platform where their Products are listed and offered for sale.
- "Payout" means the transfer of funds from PrintPort3D to a Seller for completed sales, less applicable fees and deductions.
- "Chargeback" means a reversal of a credit card or payment transaction initiated by a Buyer's bank or payment provider.
- "Fulfillment" means the process of manufacturing, packaging, and shipping Products to Buyers.
- "API" means Application Programming Interface, including any programmatic access to the Services.
- "Confidential Information" means any non-public information disclosed by one party to the other that is designated as confidential or that reasonably should be understood to be confidential.
2. Eligibility and Account Registration
2.1 Eligibility Requirements
To use the Services, you must: (a) be at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater; (b) have the legal capacity to enter into a binding contract; (c) not be prohibited from using the Services under applicable law; and (d) not have been previously suspended or removed from the Platform.
If you are using the Services on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" and "your" shall refer to both you individually and the entity you represent.
2.2 Account Registration and Security
To access certain features of the Services, you must create an Account. When creating an Account, you agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your Account information to keep it accurate, current, and complete
- Maintain the confidentiality and security of your login credentials
- Not share your Account credentials with any third party
- Immediately notify us of any unauthorized access to or use of your Account
- Accept full responsibility for all activities that occur under your Account
You acknowledge that PrintPort3D will not be liable for any losses arising from unauthorized use of your Account resulting from your failure to safeguard your login credentials. We reserve the right to suspend or terminate any Account that we reasonably believe has been compromised.
2.3 Account Verification
We may require verification of your identity, business credentials, tax information, or other details before allowing access to certain features. You agree to provide any requested documentation promptly and acknowledge that failure to complete verification may result in limited access to the Services.
3. Description of Services
3.1 Platform Services
PrintPort3D provides a technology platform that enables:
- Upload and storage of 3D model files and related Content
- Automated analysis, processing, and preparation of 3D files for manufacturing
- Price estimation and quoting for 3D printing services
- Creation and management of product listings by Sellers
- Purchase of Products by Buyers
- Order fulfillment through our network of manufacturing facilities
- Payment processing between Buyers and Sellers
- Shipping and logistics coordination
3.2 Role of PrintPort3D
PrintPort3D acts as a technology service provider and, in certain cases, a fulfillment partner. For marketplace transactions between Sellers and Buyers, PrintPort3D facilitates the transaction but is not a party to the sale agreement between Seller and Buyer. Sellers are independent contractors and are not employees, agents, or representatives of PrintPort3D.
We do not guarantee the quality, safety, legality, or availability of any Products listed on the Platform. We do not endorse any Seller, Buyer, or their Content, and we make no representations or warranties regarding the accuracy of any listings or the performance of any User.
3.3 Modifications to Services
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
3.4 Manufacturing Process and Specifications
Products manufactured through the Services are created using Additive Manufacturing technologies. You acknowledge and understand that:
- Technology Variations: Different Additive Manufacturing technologies produce different results in terms of surface finish, dimensional accuracy, material properties, and appearance. The specific technology used may vary based on availability, material selection, and production requirements.
- Material Properties: 3D printed Materials have different mechanical, thermal, and chemical properties than traditionally manufactured materials. Products may not be suitable for load-bearing, high-temperature, food-contact, or medical applications unless specifically rated and certified for such uses.
- Dimensional Tolerances: Standard Manufacturing Tolerances for Additive Manufacturing are typically ±0.3mm or ±0.5% of the nominal dimension, whichever is greater, unless otherwise specified. Tolerances may vary by technology, material, and part geometry.
- Surface Finish: 3D printed Products may exhibit visible layer lines, support marks, or surface artifacts inherent to the Additive Manufacturing process. Post-Processing services may be available for improved surface finish at additional cost.
- Color Variations: Colors of finished Products may vary from digital representations or previous orders due to material batch variations, printer calibration, lighting conditions in photographs, and monitor display settings. We do not guarantee exact color matching.
- Shrinkage and Warping: Some Materials and geometries are prone to shrinkage or warping during the printing or cooling process. While we take measures to minimize these effects, some variation is inherent to the process.
3.5 File Requirements and Processing
You are responsible for ensuring that all Files uploaded to the Services meet our technical requirements:
- File Formats: We accept STL, OBJ, 3MF, STEP, and other common 3D file formats as specified in our documentation. Files must be properly formatted and free of errors.
- Watertight Geometry: Models should have watertight (manifold) geometry with no holes, inverted normals, or non-manifold edges. We may attempt to repair minor issues automatically, but we do not guarantee successful repair of all files.
- Minimum Feature Size: Models must respect minimum feature size requirements for the selected Material and technology. Features below minimum thresholds may not print successfully or may be fragile.
- File Size Limits: Maximum file sizes apply and are subject to change. Large or complex files may require additional processing time or may be rejected.
- Scale and Units: Files must be properly scaled and use correct units. We are not responsible for Products printed at incorrect scale due to file errors.
3.6 Quality Control and Inspection
PrintPort3D implements quality control procedures but does not guarantee that every Product will be free from defects. Our quality control includes:
- Visual inspection for Manifest Errors such as failed prints, major defects, or incorrect materials
- Basic dimensional verification on a sampling basis
- Verification that the correct files were used for production
Quality control does not include: functional testing, load testing, material certification, precision measurement of all dimensions, testing for Latent Defects, or verification of fitness for any particular purpose. If you require certified quality control, precision measurements, or material certifications, you must arrange for independent third-party inspection at your own expense.
3.7 Production Time and Scheduling
Estimated production times are provided for informational purposes only and are not guaranteed. Actual production times may vary based on:
- Current order volume and production queue
- Complexity and size of the order
- Material availability
- Equipment maintenance or technical issues
- Quality issues requiring reprints
- File processing or repair requirements
We are not liable for any damages, losses, or costs arising from production delays. If timely delivery is critical, please contact us before ordering to discuss expedited options, which may be available at additional cost.
4. Intellectual Property Rights and User Content
THIS SECTION CONTAINS IMPORTANT PROVISIONS REGARDING INTELLECTUAL PROPERTY RIGHTS AND YOUR RESPONSIBILITIES AS A USER. PLEASE READ CAREFULLY.
4.1 Ownership of User Content
As between you and PrintPort3D, you retain all ownership rights in your User Content. However, by uploading, submitting, or otherwise making available any User Content through the Services, you grantPrintPort3D the licenses described in Section 4.3.
4.2 Your Representations and Warranties Regarding Content
By uploading, submitting, posting, or otherwise providing any Content through the Services, you represent, warrant, and covenant that:
- Ownership or Authorization: You are the sole creator and owner of the Content, OR you have obtained all necessary rights, licenses, consents, and permissions from the rightful owner(s) to use, reproduce, distribute, publicly display, publicly perform, create derivative works from, and commercially exploit the Content in connection with the Services
- Commercial Rights: You have the legal right to manufacture, sell, and distribute physical Products based on the Content, and such manufacture, sale, and distribution does not require any additional licenses, royalties, or payments to any third party
- No Infringement: The Content does not infringe, misappropriate, or otherwise violate any Intellectual Property Rights, privacy rights, publicity rights, moral rights, or any other rights of any third party
- No Unauthorized Third-Party Content: The Content does not incorporate any designs, characters, logos, trademarks, trade dress, or other intellectual property owned by third parties unless you have obtained express written authorization for commercial use
- Compliance with License Terms: If the Content is derived from or incorporates any third-party materials (including Creative Commons licensed works), you have fully complied with all applicable license terms, including any requirements regarding attribution, share-alike provisions, and commercial use restrictions
- No Non-Commercial Licenses: The Content is not subject to any license that prohibits commercial use, including but not limited to Creative Commons NonCommercial (CC BY-NC, CC BY-NC-SA, CC BY-NC-ND) licenses, unless you have obtained a separate commercial license
- Accuracy: All information you provide about the Content, including descriptions, origins, and licensing status, is accurate and complete
- Legal Compliance: The Content complies with all applicable laws, regulations, and industry standards
- Design Responsibility: You are solely responsible for the structural integrity, safety, and fitness for purpose of your designs. PrintPort3D does not review designs for engineering soundness, safety, or compliance with any standards.
- No Harmful Designs: The Content, when manufactured, will not create a product that is inherently dangerous, illegal, or intended to cause harm to persons or property.
4.3 License Grant to PrintPort3D
By uploading or submitting User Content, you grant PrintPort3D a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, process, prepare derivative works of, publish, transmit, display, and distribute your User Content solely for the purposes of:
- Operating, providing, and improving the Services
- Processing, analyzing, and preparing your files for manufacturing
- Manufacturing Products based on your Content
- Fulfilling Orders placed through the Platform
- Displaying your Content in connection with your product listings
- Marketing and promoting your products (with your consent where required)
- Enforcing these Terms and protecting our rights
This license continues for a commercially reasonable period after you remove or delete Content from the Services, to the extent necessary to complete any pending Orders or fulfill our legal obligations.
4.4 PrintPort3D Intellectual Property
The Services, including all software, algorithms, designs, text, graphics, logos, icons, images, audio, video, and other materials created by PrintPort3D (collectively, "PrintPort3D Content"), are owned by or licensed to PrintPort3D and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on PrintPort3D Content without our express written permission.
4.5 Feedback
If you provide us with any feedback, suggestions, or ideas regarding the Services ("Feedback"), you hereby assign to PrintPort3D all rights in such Feedback and agree that PrintPort3D may use and fully exploit such Feedback without restriction or compensation to you.
5. Prohibited Content and Conduct
5.1 Prohibited Content
You may not upload, submit, post, or transmit any Content that:
- Infringes any patent, trademark, trade secret, copyright, right of publicity, or other Intellectual Property Right of any party
- Contains trademarked characters, logos, brand names, or intellectual property owned by third parties without proper authorization
- Is derived from sources that prohibit commercial use or redistribution
- Constitutes counterfeit goods or unauthorized replicas of branded products
- Depicts or promotes weapons, weapon accessories, firearm components, or items designed to cause harm
- Contains or promotes illegal drugs, controlled substances, or drug paraphernalia
- Is pornographic, sexually explicit, or obscene
- Promotes hatred, violence, discrimination, or harassment against any individual or group
- Contains malware, viruses, or other harmful code
- Is fraudulent, deceptive, or misleading
- Violates any applicable law, regulation, or third-party rights
- Violates the privacy or publicity rights of any person
- Impersonates any person or entity or misrepresents your affiliation
5.2 Specifically Prohibited Items
Without limiting the generality of Section 5.1, the following categories of items are strictly prohibited:
- Weapons and Weapon Components: Firearms, firearm receivers, frames, or any functional firearm component; silencers or suppressors; brass knuckles, switchblades, or other prohibited weapons; weapon conversion devices; ghost gun components; bump stocks or similar devices; knives, swords, or bladed weapons; ammunition or ammunition components; crossbows or projectile launchers
- Addiction-Promoting Products: Dice, dice towers, dice trays, or dice accessories commonly associated with gambling; poker chips, casino chips, or gambling tokens; roulette wheels, slot machine components, or casino game equipment; any item designed to facilitate or promote addictive gambling behaviors that cause documented financial and psychological harm to individuals and families
- Substance-Related Items: Drug paraphernalia including pipes, bongs, hookahs, or smoking accessories; items designed to store, conceal, or facilitate the use of controlled substances; vape accessories or tobacco-related items targeting minors; alcohol-serving accessories and bar equipment (wine racks, shot glass holders, flask holders, cocktail tools) due to our commitment to not promoting substance use
- Fraudulent and Deceptive Items: Tarot card holders or fortune-telling equipment marketed as providing genuine predictions; ouija boards or "spirit communication" devices exploiting grief or superstition; palmistry or divination tools marketed with fraudulent claims; any item marketed with deceptive claims about supernatural or predictive capabilities
- Culturally Exploitative Items: Mass-produced replicas of sacred cultural artifacts; items that commodify or trivialize religious or spiritual practices of any tradition; culturally significant items produced without appropriate community involvement or consent
- Adult and Explicit Content: Pornographic or sexually explicit items; sex toys or adult novelty items; items depicting nudity or sexual acts; lingerie displays or adult costume accessories
- Trademark Violations: Replicas or counterfeits of branded products; unauthorized use of sports team logos, movie characters, video game characters, or celebrity likenesses; fan art without commercial license
- Safety Hazards: Items designed to defeat safety mechanisms; lock picks or bypass tools (where prohibited); devices intended to facilitate illegal activity
- Hate Symbols: Items depicting or promoting hate symbols, terrorist organizations, or extremist ideologies
- Regulated Materials: Items containing asbestos, lead, or other hazardous materials; items that would require special disposal
- Privacy Violations: Hidden cameras or surveillance devices; signal jammers; devices designed to intercept communications
- Government/Military Items: Military insignia, badges, or credentials; items that could be mistaken for official government documents or equipment
- Predatory Financial Products: Items promoting predatory lending, exploitative interest rates, or payday loan services; merchandise glorifying debt traps or financial exploitation of vulnerable communities
5.2.1 Absolute Right to Remove Products and Cancel Sales
PrintPort3D reserves the absolute and unconditional right to remove any product, listing, design, or Content from the Platform for any reason or no reason, at any time, without prior notice, and without any obligation to provide an explanation. This includes but is not limited to products that we determine, in our sole and absolute discretion:
- May violate any of the prohibitions listed in this Section 5
- May be inconsistent with our company values, ethics, or brand image
- May be objectionable, offensive, or inappropriate for any reason
- May pose reputational risk to PrintPort3D
- We simply do not wish to manufacture, fulfill, or be associated with
PrintPort3D further reserves the absolute and unconditional right to cancel any sale, order, or transaction for any reason or no reason, at any time, including after an order has been placed or payment has been received. In the event of such cancellation, our sole obligation shall be to refund any payment received for the cancelled order. We shall have no liability for any consequential, incidental, or indirect damages arising from such removal or cancellation.
By using our Services, you acknowledge and agree that our exercise of these rights is final, non-appealable, and not subject to review by any court, arbitrator, or other third party. You waive any right to challenge, dispute, or seek damages related to our exercise of these removal and cancellation rights.
5.3 Prohibited Conduct
You agree not to:
- Use the Services for any illegal purpose or in violation of any applicable law
- Circumvent, disable, or interfere with security features of the Services
- Use any robot, spider, scraper, or other automated means to access the Services
- Reverse engineer, decompile, or disassemble any aspect of the Services
- Interfere with or disrupt the Services or servers connected to the Services
- Collect or harvest any personal information from other Users
- Create multiple Accounts for deceptive purposes
- Engage in price manipulation, fake reviews, or other deceptive practices
- Use the Services to send spam or unsolicited communications
- Attempt to gain unauthorized access to any portion of the Services or any other systems or networks
- Use the Services to transmit any malware, viruses, worms, or other malicious code
- Probe, scan, or test the vulnerability of our systems without authorization
- Assist or enable any third party in doing any of the above
5.4 Content Monitoring and Removal
PrintPort3D has no obligation to monitor User Content but reserves the absolute right to review, screen, remove, edit, refuse, or reject any Content at our sole and absolute discretion, without notice and without any obligation to provide a reason. We may remove Content that we believe violates these Terms, infringes third-party rights, is otherwise objectionable, or that we simply do not wish to host or be associated with for any reason. Our decision to remove or not remove Content does not constitute endorsement or verification of any Content. You acknowledge that we may exercise this right at any time, for any reason or no reason, and you waive any claim against PrintPort3D related to the removal of your Content.
5.5 Reporting Violations
If you become aware of any Content that violates these Terms or applicable law, please report it to us atsupport@printport3d.com. We will investigate reports and take appropriate action, which may include removing Content, suspending Accounts, or reporting to law enforcement. We are not obligated to take any specific action or to disclose the results of our investigation.
5.6 Consequences of Violations
Violations of this Section 5 may result in:
- Immediate removal of the offending Content without notice
- Suspension or termination of your Account
- Forfeiture of any pending payouts or balances
- Permanent ban from the Platform
- Reporting to law enforcement agencies
- Legal action to recover damages and enforce these Terms
6. Digital Millennium Copyright Act (DMCA) Policy
6.1 Commitment to Intellectual Property Rights
PrintPort3D respects the intellectual property rights of others and expects our Users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to notices of alleged copyright infringement that comply with the DMCA and other applicable intellectual property laws.
6.2 DMCA Takedown Notice Requirements
If you believe that your copyrighted work has been copied and is accessible on the Services in a way that constitutes copyright infringement, please provide our DMCA Agent with a written notification containing the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
- Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (including URL(s))
- Your contact information, including your address, telephone number, and email address
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

6.4 Counter-Notification
If you believe that your Content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA Agent containing: (a) your physical or electronic signature; (b) identification of the material that was removed and the location where it appeared before removal; (c) a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification; (d) your name, address, and telephone number; and (e) a statement that you consent to the jurisdiction of the federal court in your district and will accept service of process from the person who provided the original notification.
6.5 Repeat Infringer Policy
PrintPort3D maintains a policy of terminating, in appropriate circumstances, the Accounts of Users who are determined to be repeat infringers of intellectual property rights. We may, at our sole discretion, limit access to the Services or terminate the Account of any User who infringes the intellectual property rights of others, whether or not there is any repeat infringement.
7. Seller Terms
7.1 Seller Responsibilities
If you use the Services as a Seller, you additionally agree to:
- Comply with all applicable laws and regulations, including consumer protection, product safety, and tax laws
- Provide accurate and complete information about your Products, including descriptions, specifications, and pricing
- Fulfill Orders promptly and in accordance with your stated shipping times
- Respond to Buyer inquiries and resolve disputes in good faith
- Maintain appropriate business licenses and registrations as required by law
- Collect and remit all applicable taxes
- Comply with all export control and sanctions laws
7.2 Product Listings
All product listings must be accurate, complete, and not misleading. You are solely responsible for the accuracy of your listings, including product descriptions, images, pricing, and availability. PrintPort3Dreserves the right to remove or modify any listing that violates these Terms or that we determine, in our sole discretion, is inappropriate.
7.3 Seller Fees and Payments
Sellers agree to pay all applicable fees as set forth in our fee schedule, which may be updated from time to time. Payouts to Sellers are subject to our payout schedule and any applicable holds or reserves.PrintPort3D reserves the right to withhold, deduct, or offset any amounts owed to you against amounts you owe to us, including chargebacks, refunds, fees, and damages arising from your breach of these Terms.
- Transaction Fees: A percentage-based fee is charged on each completed sale, as specified in your seller dashboard or our published fee schedule.
- Payment Processing Fees: Third-party payment processor fees are passed through to Sellers or deducted from Payouts.
- Payout Schedule: Payouts are processed according to our standard schedule, typically within 7-14 business days after order completion, subject to any holds or reserves.
- Minimum Payout Threshold: We may establish minimum payout thresholds. Balances below the threshold will be carried forward to the next payout period.
- Reserves: We may hold a percentage of your earnings in reserve to cover potential chargebacks, refunds, or disputes. Reserve amounts and release schedules are determined at our discretion based on your account history and risk profile.
- Currency: All transactions and payouts are processed in U.S. Dollars. Currency conversion fees may apply for non-U.S. bank accounts.
- Tax Reporting: We will issue applicable tax forms (such as IRS Form 1099-K) as required by law. You are responsible for providing accurate tax information and for paying all applicable taxes on your earnings.
7.4 Seller Conduct and Performance Standards
Sellers are expected to maintain high standards of conduct and performance, including:
- Response Time: Responding to buyer inquiries within 48 hours
- Order Fulfillment: Fulfilling orders within stated production times
- Accurate Listings: Maintaining accurate and up-to-date product listings
- Quality Standards: Delivering products that match listing descriptions and images
- Customer Service: Handling customer complaints and issues professionally and promptly
- Compliance: Complying with all applicable laws, regulations, and PrintPort3D policies
Failure to meet performance standards may result in account warnings, suspension, reduced visibility in search results, increased reserve requirements, or account termination.
7.5 Independent Contractor Status
Sellers are independent contractors and not employees, agents, joint venturers, or partners of PrintPort3D. Nothing in these Terms creates an employment, agency, or partnership relationship. Sellers are solely responsible for their own taxes, insurance, and compliance with applicable laws.
7.6 Product Liability and Insurance
Sellers are solely responsible for any claims arising from the Products they sell, including but not limited to product liability claims, personal injury claims, and property damage claims. We strongly recommend that Sellers obtain appropriate product liability insurance. PrintPort3D may require proof of insurance for certain product categories or high-volume sellers. PrintPort3D shall not be liable for any claims arising from Products sold by Sellers.
7.7 Seller Intellectual Property Indemnification
In addition to the general indemnification obligations in these Terms, Sellers specifically agree to indemnify, defend, and hold harmless PrintPort3D and its Indemnified Parties from and against any and all claims, damages, losses, costs, and expenses (including attorneys' fees) arising from or related to any claim that the Seller's Content or Products infringe, misappropriate, or violate any third party's Intellectual Property Rights. This includes claims from original designers, trademark holders, copyright owners, and any other rights holders.
8. Buyer Terms
8.1 Purchases
When you place an Order through the Platform, you are making an offer to purchase Products. Your Order is accepted when we send you confirmation of shipment or delivery. All purchases are subject to product availability and our acceptance of your Order.
We reserve the right to refuse or cancel any Order for any reason, including but not limited to: product unavailability, errors in pricing or product information, suspected fraud, or violations of these Terms. If your Order is canceled after payment, we will issue a full refund to your original payment method.
8.2 Pricing and Payment
All prices are displayed in U.S. Dollars unless otherwise indicated. Prices are subject to change without notice. You agree to pay all charges incurred in connection with your Orders, including product prices, shipping costs, and applicable taxes. Payment must be made through our approved payment methods at the time of Order.
- Price Changes: Prices may change at any time, but changes will not affect Orders that have already been placed and confirmed.
- Pricing Errors: In the event of a pricing error, we reserve the right to cancel the Order and issue a refund, or to contact you to confirm whether you wish to proceed at the correct price.
- Taxes: You are responsible for all applicable sales taxes, use taxes, VAT, customs duties, and other governmental charges. Taxes may be calculated and added at checkout based on your shipping address.
- Promotional Codes: Promotional codes and discounts are subject to specific terms and conditions and may be limited, modified, or discontinued at any time.
8.3 Shipping and Delivery
Delivery times are estimates only and are not guaranteed. Risk of loss and title to Products pass to you upon delivery to the carrier. PrintPort3D is not responsible for delays caused by carriers, customs, weather, or other factors beyond our control.
- Shipping Methods: Available shipping methods and rates vary by destination, package size and weight, and carrier availability.
- Delivery Estimates: Estimated delivery dates are calculated based on production time plus estimated shipping time and are not guaranteed.
- Address Accuracy: You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by the Buyer.
- International Shipping: International orders may be subject to customs duties, import taxes, and other fees imposed by the destination country. These charges are the Buyer's responsibility and are not included in the order total.
- Shipping Restrictions: Some products may not be available for shipping to certain locations due to legal restrictions, carrier limitations, or export controls.
- Lost or Damaged Shipments: If your shipment is lost or damaged in transit, please contact us within 14 days of the expected delivery date. We will work with the carrier to resolve the issue and may provide a replacement or refund at our discretion.
- Signature Requirements: Some orders may require signature upon delivery. If you are unavailable to sign, the carrier will follow their standard redelivery or hold procedures.
8.4 Returns and Refunds
Due to the custom, made-to-order nature of 3D printed Products, all sales are generally final. Refunds or replacements may be provided at our discretion in cases of manufacturing defects, shipping damage, or significant deviation from the product description. Requests must be submitted within fourteen (14) days of delivery. Custom orders and personalized items are non-refundable except in cases of defects.
- Defective Products: If you receive a Product with manufacturing defects or Manifest Errors, we will provide a replacement or refund at our discretion. You may be required to provide photographs of the defect.
- Shipping Damage: Products damaged during shipping may be eligible for replacement or refund. You must report damage within 48 hours of delivery and provide photographs of the damaged product and packaging.
- Wrong Item: If you receive the wrong item, we will ship the correct item at no additional cost and may provide a prepaid return label for the incorrect item.
- Buyer's Remorse: We do not accept returns or provide refunds for products that you simply no longer want, that don't meet your subjective expectations, or for reasons unrelated to product defects.
- Design Errors: We are not responsible for errors in your design files or specifications. Products manufactured according to your submitted files are not eligible for refund due to design errors.
- Refund Processing: Approved refunds will be issued to the original payment method within 5-10 business days.
8.5 Order Cancellation
Orders may be canceled only if production has not yet begun. Once production has started, Orders cannot be canceled. To request cancellation, contact us immediately after placing your Order. Cancellation requests are not guaranteed and are processed on a best-effort basis. If cancellation is approved, a full refund will be issued to your original payment method.
8.6 Product Safety and Use
You acknowledge and agree that:
- 3D printed Products are not toys and should be kept away from children unless specifically designed and rated for child use
- Products are not food-safe unless specifically indicated and made with food-safe materials and processes
- Products are not medical devices and should not be used for medical purposes
- Products may have sharp edges, small parts, or other characteristics that could pose safety risks
- You are solely responsible for determining whether a Product is suitable for your intended use
- You assume all risks associated with the use of Products purchased through the Platform
9. Payment Terms
9.1 Payment Processing
All payments are processed through third-party payment processors (such as Stripe). By making a payment, you agree to the terms and conditions of our payment processors. PrintPort3D does not store complete credit card information on our servers.
9.2 Authorization
You authorize PrintPort3D and our payment processors to charge your designated payment method for all fees, charges, and amounts owed in connection with your use of the Services. You represent and warrant that you have the legal right to use any payment method you provide.
9.3 Chargebacks and Disputes
If you initiate a chargeback or payment dispute, we reserve the right to suspend your Account pending investigation. Fraudulent chargebacks may result in permanent Account termination and collection actions for amounts owed plus associated fees.
10. Third-Party Services and Links
The Services may contain links to third-party websites, services, or resources, or may integrate with third-party services (including payment processors, shipping carriers, and analytics providers). These third-party services are not under our control, and we are not responsible for their content, privacy practices, or terms of service. Your use of third-party services is at your own risk and subject to the terms and policies of those third parties.
11. Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our collection, use, and disclosure of your information as described in our Privacy Policy.
California residents have additional rights under the California Consumer Privacy Act (CCPA), as described in our Privacy Policy.
12. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmlessPrintPort3D, its parent, subsidiaries, affiliates, officers, directors, employees, agents, licensors, suppliers, and any third-party information providers (collectively, "Indemnified Parties") from and against all claims, demands, actions, suits, proceedings, losses, damages, costs, expenses, and liabilities, including reasonable attorneys' fees and court costs, arising out of or relating to:
- Your use of or access to the Services
- Your User Content, including any claim that your User Content infringes, misappropriates, or violates any third party's Intellectual Property Rights, privacy rights, publicity rights, or other rights
- Any Products you design, list, sell, manufacture, or distribute through the Services
- Your violation or alleged violation of these Terms
- Your violation or alleged violation of any applicable law, regulation, or third-party right
- Any dispute between you and any third party, including other Users
- Any claim that your Content caused damage to a third party
- Any misrepresentation made by you regarding ownership or licensing of Content
This indemnification obligation will survive the termination of these Terms and your use of the Services.PrintPort3D reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.
13. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRINTPORT3D DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
PRINTPORT3D DOES NOT WARRANT THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS; OR (E) ANY ERRORS IN THE SERVICES WILL BE CORRECTED.
PRINTPORT3D MAKES NO WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY USER CONTENT OR THIRD-PARTY CONTENT. PRINTPORT3D DOES NOT WARRANT THAT ANY USER CONTENT IS NON-INFRINGING OR THAT USERS HAVE THE RIGHTS THEY CLAIM TO HAVE.
ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRINTPORT3D, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER PRINTPORT3DHAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH:
- YOUR USE OF OR INABILITY TO USE THE SERVICES
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
- ANY USER CONTENT OR THIRD-PARTY CONTENT OBTAINED FROM THE SERVICES
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR TRANSMISSIONS
- ANY PRODUCTS PURCHASED OR OBTAINED THROUGH THE SERVICES
- ANY INTELLECTUAL PROPERTY CLAIMS RELATED TO USER CONTENT
IN NO EVENT SHALL PRINTPORT3D'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE AMOUNTS PAID BY YOU TOPRINTPORT3D DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND REGARDLESS OF WHETHER PRINTPORT3DHAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
15. Force Majeure
PrintPort3D shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, accidents, strikes, labor disputes, shortages of transportation, facilities, fuel, energy, labor, or materials, pandemics, epidemics, government orders or restrictions, or failures of third-party services, telecommunications, or internet infrastructure.
16. Termination
16.1 Termination by You
You may terminate your Account at any time by contacting us at support@printport3d.com. Termination does not relieve you of any obligations incurred prior to termination, including payment obligations and pending Orders.
16.2 Termination by PrintPort3D
We may suspend or terminate your Account and access to the Services immediately, without prior notice or liability, for any reason, including without limitation: (a) breach of these Terms; (b) fraudulent or illegal activity; (c) non-payment of fees; (d) upon request by law enforcement or government agencies; (e) unexpected technical or security issues; or (f) extended periods of inactivity.
16.3 Effect of Termination
Upon termination: (a) your right to use the Services will immediately cease; (b) we may delete your Account and Content; (c) any pending Orders may be canceled; and (d) any amounts owed to PrintPort3D become immediately due and payable. Sections that by their nature should survive termination shall survive, including Sections 4 (Intellectual Property), 5 (Prohibited Content), 6 (DMCA), 12 (Indemnification), 13 (Disclaimer), 14 (Limitation of Liability), 19 (Governing Law), and 20 (Arbitration).
17. Export Compliance
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control. You represent that you are not located in, under the control of, or a national or resident of any country subject to U.S. embargo or sanctions.
18. U.S. Government Rights
If you are a U.S. government entity or the Services are being acquired for use by or on behalf of the U.S. government, the Services constitute "commercial computer software" and "commercial computer software documentation" as such terms are used in 48 C.F.R. 12.212, and are provided with restricted rights as set forth in 48 C.F.R. 12.211 and 12.212.
19. Governing Law and Jurisdiction
These Terms and any dispute arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
Subject to the arbitration agreement below, you agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you hereby consent to the personal jurisdiction and venue of such courts.
20. Arbitration Agreement and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
20.1 Agreement to Arbitrate
You and PrintPort3D agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (including their formation, performance, or breach), or any other dispute between you and PrintPort3D (collectively, "Disputes"), shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring individual claims in small claims court if the claims qualify.
20.2 Arbitration Rules and Procedures
Arbitration shall be conducted by JAMS under its Comprehensive Arbitration Rules and Procedures (or, for claims under $250,000, its Streamlined Arbitration Rules), as modified by this Section. The arbitration will be conducted by a single arbitrator selected in accordance with JAMS rules. The arbitration shall take place in Los Angeles, California, unless the parties agree otherwise or the arbitrator determines that an in-person hearing is not necessary.
20.3 Class Action Waiver
YOU AND PRINTPORT3D AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
20.4 Waiver of Jury Trial
YOU AND PRINTPORT3D HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. You and PrintPort3D are instead electing to have all Disputes resolved by arbitration.
20.5 Opt-Out
You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to legal@printport3d.com within thirty (30) days of first accepting these Terms. Your notice must include your name, address, email address, and an unequivocal statement that you want to opt out of this arbitration agreement. If you opt out, you and PrintPort3D may litigate disputes in court, subject to the governing law and jurisdiction provisions above.
20.6 Severability
If any part of this arbitration agreement is found to be unenforceable, the remainder shall continue to apply, except that if the class action waiver is found to be unenforceable, the entire arbitration agreement shall be void.
21. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Services and updating the "Effective Date" and "Last Updated" dates above. We may also notify you by email or through a notice on the Platform.
Your continued use of the Services after such modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and terminate your Account.
22. General Provisions
22.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and PrintPort3D regarding the Services and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
22.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
22.3 Waiver
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by PrintPort3D.
22.4 Assignment
You may not assign, delegate, or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction and without notice to you. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties and their respective successors and assigns.
22.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms.
22.6 Notices
We may provide notices to you by email to the address associated with your Account, by posting on the Services, or by any other reasonable means. You are responsible for keeping your contact information current. Notices are deemed received when sent by email (unless we receive a bounce-back) or when posted on the Services.
22.7 Headings
The section headings in these Terms are for convenience only and have no legal or contractual effect.
22.8 California Residents
If you are a California resident, in accordance with California Civil Code Section 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
